Contract Offer – User Agreement

1. General provisions

1.1. This Agreement (hereinafter referred to as the Agreement or the Agreement) is a combination of a public offer and a User Agreement, which defines the terms of use of the Site www.knmarket.info (hereinafter referred to as the Site) and the purchase of a product by users (buyers). In this Agreement, the Parties are the User (Buyer) and the Site Administration (Seller). The Parties understand the product (goods) as a course of lectures specified on the Site in accordance with the tariffs and other information.

1.2. This Agreement is a public offer and is intended for an unspecified circle of persons (individuals, individual entrepreneurs) who wish to purchase goods on the Site. The seller of the goods is NURLANE KRAUZ PR NOVI SAD.

1.3. Since this Agreement is a public offer, by accepting the terms and conditions issued on the Site or making a payment through the Site, the User (Buyer) is considered to be bound by this Agreement.

1.4. The Site Administration (the owner of the Site NURLANE KRAUZ PR NOVI SAD and/or its authorized representatives) has the right to unilaterally change the terms of this Agreement at any time. New or amended terms shall enter into force from the moment of their posting on the Site. If the User disagrees with such changes, he is obliged to refuse further use of the Site and stop using the materials and services of the Site.

1.5. The Buyer agrees to the terms of this public offer without any restrictions when using the Site.

1.6. The User (Buyer) confirms understanding of all terms and conditions of the Agreement and accepts them fully and unconditionally.

2. Placing Orders on the Site

2.1. To place orders on the Site (i.e. to pay and gain access to the course), the User (Buyer) selects the appropriate tariff on the Site and goes to the payment system to pay for the product or can contact the phone number specified on the Site.

2.2. When placing an order, the Buyer provides his name, email address, telephone number and other necessary data.

2.3. The User (Buyer) agrees that the price of the product indicated on the Site may change.

2.4. The product listed on the Site is not subject to return.

2.5. Payment is made through the payment systems LiqPay, Way4pay or others provided by the Site.

2.6. Payment is made in the national currency by cashless means.

3.Privacy and Personal Data

3.1. Confidentiality

Unless the prior written consent of the other party is required or is established by law:

3.1.1. Each party shall maintain the confidentiality of Confidential Information received under this Agreement. Neither party shall have the right to disclose or transfer confidential information or personal data to any person or use them for its own purposes without the prior written consent of the other party, except as provided in this Agreement.

3.1.2. The obligations of each party shall survive the termination of these terms and conditions.

The provisions of paragraphs 3.1.1 and 3.1.2 do not apply to any information that:

• becomes publicly available, except in cases of violation of these conditions;
• received from a third party who legally acquired it and does not restrict its disclosure;
• is in the possession of the receiving party without restrictions on disclosure until received from the disclosing party; or
  is independently developed without access to the Confidential Information.

3.2. Privacy

The Seller adheres to the Privacy Policy and Cookie Policy, which contain data obligations. The User is obliged to familiarize himself with these policies and accept them in order to agree to the terms of this Agreement.

3.3. Legislation

4.The Seller acts in accordance with the current legislation of Serbia.

4.1. The Administration is not responsible for any inaccuracies, typographical errors or errors that may appear in the materials on this Site. Despite the fact that the Administration makes every effort to ensure the accuracy and reliability of the information on the Site, all data and materials are provided “as is”, without any guarantees, both express and implied.

4.2. Statements and opinions left by users (buyers) of the Site in the form of comments or reviews are the responsibility of the respective users, and not of the Administration.

4.3. The Administration is not responsible for illegal actions of users (buyers) against third parties or for actions of third parties against users/buyers.

4.4. The Administration is not responsible for any damage, loss or expense (actual or potential) that may arise as a result of the use or inability to use the Site.

4.5. In accordance with the above, the Administration has the right to delete information posted on the Site and take technical and legal measures to terminate access of users (buyers) who create problems in the use of the Site by other users (buyers) or violate the terms of the Agreement.

4.6. The Site Administration, including the Site owner, is not responsible for:

4.6.1. Delays or failures in the process of carrying out operations due to force majeure circumstances or any technical malfunctions.

4.6.2. Actions of transfer systems, banks, payment systems and for delays associated with their work.

4.6.3. Proper functioning of the Site if the user (buyer) does not have the necessary technical means to use it, and is also not obligated to provide users with such means.

5. Intellectual property

5.1. All intellectual property rights relating to the Site and the content posted on it belong to the Seller (or its licensors).

5.2. The owner of all rights to the Site and the course (product on the Site) is NURLANE KRAUZ PR NOVI SAD. By purchasing the course (product, good) offered on the Site, the Buyer receives only the rights to personal use of the course, without the possibility of transfer, use of its materials for commercial purposes or in the interests of third parties. Nothing in the agreement provides for the transfer of ownership rights to the materials of the Site and the course.

6. Return Policy

6.1. The Site Owner does not refund payments or make refunds if the goods are provided in accordance with the tariff and conditions specified on the Site.

6.2. The Buyer has the right to contact the Administrator for a refund within 14 calendar days from the date of payment, only if access to the course was not provided according to the tariff and date (data) on the Site, unless otherwise provided by the legislation of Serbia.

6.3. To receive a refund of the funds paid, please contact info@knmarket.info.

7. Other

7.1. A person who is not a party to this Agreement shall not have the right to enjoy the benefits of this Agreement and apply them.

7.2. If any part or provision of this Agreement is invalid, unenforceable or contrary to law, that part or provision shall be replaced by a provision that, to the extent possible, accomplishes the original purpose of that part or provision. The rest of this Agreement shall remain in full force and effect.

7.3. Neither party shall be liable for any delay or failure to perform its obligations under this Agreement if the delay or failure is due to any cause beyond its reasonable control. This clause does not apply to any obligations to pay money.

7.4. The User does not have the right to assign or transfer any rights to any other person without the prior written consent of the Seller.

7.5. This Agreement shall be governed and construed in accordance with the laws of Serbia.

7.7. If it is impossible to resolve disputes through negotiations, all disputes shall be resolved in court in accordance with the current legislation of Serbia.
